Medical marijuana in Ohio - Are you prepared for it?

HB523 creates the ability for licensed physicians to issue permission for medical marijuana usage. While it’s likely to be a year or two before the entire system and providers are in place, it’s already raising a number of questions and concerns among employers.

  • Is an employer prohibited from refusing to hire, discharging, disciplining or otherwise taking an adverse employment action against a person with respect to hire, tenure, terms, conditions or privileges of employment because of that person’s use, possession or distribution of medical marijuana?
  • Is the employer prohibited from establishing and enforcing a drug testing policy, drug-free workplace policy, or zero tolerance drug policy?
